HC directive to improve facilities at waterfalls

The Madras High Court today issued as many as 33 directives to the Tirunelveli district administration and other officials concerned to improve facilities available at the Courtallam falls. 

Justice N Kirubakaran and Justice S Vadiyanathan of Madurai bench gave the direction while passing interim orders on a PIL by one R Krishnasamy. 

The bench appointed advocate-commissioners and based on their report, gave the direction. The authorities concerned should file compliance report also, the Division bench said. 

The directive prohibited use of oil, shampoos, soaps, detergents, chemicals and shikakai, plastic items and washing of clothes in the bath area of all the falls and sale of these items, as the water is the main source of drinking water for the people in Tirunelveli district. 

The safety pillars and railings should be made of materials which do not rust due to water and climatic conditions and they have to be erected, fixed and painted before the season begins. 

More high mast lights should be erected and maintained properly to prevent any offence being committed under the cover of darkness. 

More toilets should be constructed at the falls area as well as at the bus stand and women appointed exclusively for maintenance of women toilets and dressing rooms. 

The bench also restrained the authorities concerned from discharging the sewage into the river. The drinking water 'RO' system near the main falls should be repaired and such systems have to be provided at the earliest. 

The bench also directed the government authorities to shift 'TASMAC' shops near the falls to far away places. Health inspectors should visit hotels and eateries and check the quality of food served. Unhygienic hotels should be sealed. 

More police men should be recruited. Drunken driving must be curtailed and mobile courts be stationed to prevent people from indulging in criminal activities. 

The health centre/hospital should be kept open round the clock to meet medical emergencies. Ambulances and rescue teams must be stationed near the falls. 

Encroachments made by shop keepers and vendors should be removed. CCTV cameras should be installed in important locations like car parking areas, falls area, temple, and bus stand, the bench said.

N.KIRUBAKARAN, J

The CELELSTEAL MARRIAGE of LORDSHIVA and GODDESS PARVATHI was celebrated in Mount Himalayas. Everyone on the Earth wanted to have a glimpse of the divine celebration and thronged the Himalayas thereby the northern side of the Earth went down. To balance the Southern side, Lord Shiva sent "Sage Agasthya" to South. The place where "Sage Agasthya" landed is called "COURTALLAM", where the falls lands is the subject matter of the writ petition. This is the mythological story about "COURTALLAM".

2. NATURE exhibits its magnificent beauty in myriad ways and one such wonderful form is FALLS.

Viewing the Falls is mesmerising;

Hearing its sound is enthralling;

Bathing in the Falls is electrifying;

ANGEL FALLS in Venezuela is the tallest falls at 979 m. "COURTALLAM" is well-known for its Natural Falls and called as "Spa of South India" or "Poorman's Ooty". Courtallam is located at an elevation of about 167 kilometers in the main elevation of Western Ghats in Tamil Nadu which is home to numerous rare flora and fauna. Chittar River, Pachaiyar, Manimutharu and Tamaraparani originate here. There are many Falls and Cascades, which form the exceptional beautiful background near the temple. It looks like the rhythmic sounds of the falls provides natural music to the cosmic dance of God Shiva, who is believed to be dancing in one of the five Sabhas, namely Chitra Sabha located in Arulmighu Courtalla Nathar Thirukoil The other Sabhas, known as Dancing Halls of Lord Shiva, are Golden Sabha at Chidambaram, Rathina Sabha at Thiruvalangadu, Silver Sabha at Madurai and Copper (Thamiram )Sabha at Tirunelveli. Saint Sambandar praises the God of "Courtallam" as "Kurumpala Eswarar" in Thevaram.


The above song in " Thirukkutrala Kuravanji" written by Thirikuda Rasappa Kavirayar says that sins would go off by having bath in the Courtallam falls which is equal to river Ganga. When such is the glory and beauty of falls in Courtallam, the present day position is pathetic and abysmal, which compelled the petitioner to approach this Court by way Public Interest Litigation, seeking proper maintenance of the Falls.

3. According to the petitioner, the Falls in Courtallam are Natural Falls and they deserve proper maintenance and care. During the season, namely in the middle of May, several lakhs of people throughout South India, visit the place to enjoy the pleasure of taking bath in the Falls, which have medicinal effects for physical as well as mental health. When the petitioner visited Courtallam in the second week of May, 2013, he was shocked to find that the place lacks basic amenities and proper security for the visiting public during the season. According to the petitioner, there is no proper Police Force found to regulate the visitors, the traffic is uncontrollable and not regulated despite levying heavy charges; There are no rooms available for changing clothes for both men and women, who are compelled to change their dress in open places; For the huge crowd, which is visiting Courtallam, there are no sufficient and strong barricades to protect them in the Falls area; There are several holes and cavities in the bath area and the place lacks proper maintenance by the authorities; Many people got fractures while taking bath and there is no feasible mode to control the huge crowd.

4. That apart, there is not even a First Aid Centre available in Courtallam to provide medical facilities and life saving measures in case of emergency; There is no rescue operation team provided to safeguard the life and property of the visiting public; Some people, come in mobs, and consume liquor openly on roads by parking their vehicles and the public, especially, women and children, are unable to walk on the public road to reach the Falls; People are allowed to take bath after consuming liquor, which, sometimes, results in death; There is drunken driving in the area resulting in many accidents; The fee collected for parking vehicles is very high and there are no boards indicating parking fee; There are no direction boards or sign boards indicating the path to reach the Falls; Giving the details about the pathetic condition prevailing in Courtallam, and the apathetic attitude of the authorities, the petitioner seeks a direction to provide adequate facilities, safety measures and protection to tourists, who visit Old Courtallam Falls and to forbear the respondents from allowing any illegal activities against public safety, life and comfort, in Old Courtallam Falls.

5. Understanding the gravity of the problems, this Court directed the Assistant Superintendent of Police, Tenkasi, Revenue Divisional Officer, Tenkasi, the Executive Engineer, P.W.D and the Block Development Officer, Panchayat Union of Tenkasi to be present before this Court. The Executive Engineer, PWD, the 4th respondent herein filed a report dated 22.05.2014 stating that all the facilities are available in Old Courtallam Falls, whereas, Mr.Veera Kathiravan, learned counsel for the petitioner would dispute the report stating that it contains falsehood. To ascertain the real facts, this Court, by order dated 22.05.2014, appointed Mr.T.S.R. Venkatramana, a Senior Member of the Bar and Former Member of Tamil Nadu Legislative Assembly, who is to be assisted by Mr.Arun @ Arunachalam as Advocate Commissioners to inspect the Falls in Courtallam and file a report on 24.05.2014 in regard thereto. Though the relief sought in the petition is confined to Old Courtallam Falls, in view of many Falls available in Courtallam, this Court, comprehensively, wanted to know the position prevailing in Courtallam and therefore, directed the Advocate Commissioners to file a report about all the Falls in Courtallam. Accordingly, they visited the Courtallam, the next day, on 23.05.2014 and promptly filed the report on 24.05.2014. The details found in the report are in consonance with the picture painted by the petitioner. Even when the matter came up for admission on 21.5.2014, the petitioner produced photographs to show how badly the Falls Area is maintained. However, a few photographs have been exhibited by the Government Pleader to show that everything is fine in the Falls area in Courtallam.

6. The report of the Advocate Commissioners gives the details of the sorry state of affairs in Courtallam and they are as follows:

(a) Old Courtallam Falls:

Pits are found in the bathing area of the Falls, which were formed due to uprooted iron pillars meant for railings; The toilets are in dilapidated and defective condition; Lighting facilities in Old Falls area and other Falls area are very poor; The high mast lights in the Old Falls are not functioning for months together; There is no exclusive dressing room for women.

(b) Main Falls:

Most of the railings are missing; Sewage from the temple is directly drained into the river; Drinking Water RO System near the Main Falls is not working.

(c) Five Falls:

The Flooring and railings in the Five Falls area are in bad shape. 

(d) Public Convenience:

There is heavy garbage dumped in the area, which is not properly cleared.

(e) Security and Traffic:

There is no effective regulation of traffic as the number of vehicles entering Courtallam is heavy and uncontrollable; There is drunken driving endangering the safety of the public and consumption of liquor on roads and public places has become an open affair resulting in accidents; There is no bar attached to Tasmac Shops; There are no boards informing the permitted rates of parking; There are no direction boards; There are no medical and First Aid facilities in the Falls area; Though the use of soaps and shampoos are prohibited, they are sold in the Falls Area and therefore, the people are freely getting those prohibited items; That apart, when Mr.Arun, one of the Advocate Commissioners visited Old Courtallam, in the night of 22.5.2014, he could see cleaning and transporting of debris by P.W.D. hurriedly and fixing of railing in a hurried way.

6a. Both parties were given the copy of the report and they were required to file their suggestions for improving the facilities in the Falls area and the suggestions were also filed 25.05.2014.

7. Mr.Veera Kathiravan, learned counsel for the petitioner reiterated what has been stated in the affidavit. He would also rely and refer to the Advocate Commissioners' report about the present status of the Falls and seek appropriate directions to improve the situation.

8. On the other hand, Mr.Krishna Doss, learned Government Advocate and other respondents would contend that already, enough facilities are available and steps would be taken to improve the situation.

9. After reading the news paper report dated 23.5.2014 about the hearing of this case by this court, Mr.Ponnambalam Karunanithi, a resident of England bearing Passport No.-C4YM4YWO appeared in person on 24.5.2014 and stated that he found a lot of problems viz. Broker menace, lack of guides, locker facilities in Courtallam and filed an affidavit dated 25.05.2014 to that effect.

10. Officers including the Superintendent of Police present before this Court assured that they would take appropriate steps to provide all the required facilities for the visiting public during the season.

11. This Court, after perusing the entire records, hearing the parties and perusing the Advocate Commissioners' report, has come to the conclusion that the Famous Courtallam is not maintained in tune with its historical fame and glory and it has not been given due importance, which it deserves, given the beautiful locations, which has potential to attract many tourists including foreigners. Falls are very rare and natural falls are rare among the rarest. When the nature has given its bounty, it is rather an obligation cast upon the authorities to maintain the Falls in a proper manner so that the people, who throng the area during the season, can have safe bathing in the Falls.

12. There are five waterfalls in Courtallam, namely, Old Falls, Main Falls, Five Falls, Honey Falls and Shenbagadevi Falls. As already described in the opening paragraphs, Literature praises the mythological glory and fame of the hills and Temple in Courtallam; the Natural Waterfalls have got medicinal properties, which have an healing effect, not only on the body, but also on the mind; it is believed that the water from the Falls contains natural minerals and herbal properties to cure even a person of unsound mind. However, the manner in which the Falls in Courtallam are maintained, people are bound to get diseases by taking bath in the Falls, instead of getting cured of their ailments.

13. It is very shocking to note that Toilet sewage is drained into the river, when the river is supposed to be the source of drinking water for the people in Tenkasi and Tirunelveli area. Such is the sensitivity exhibited by the authorities in maintaining the toilets and the responsibility in preserving the river. When it is believed that the Waterfalls contain medicinal values, it should not be polluted by use of shampoos, soaps, oil, detergents and shikakai by the visitors. Though the local Town Panchayat has prohibited the sale of these items, near the Falls area, it is seen that no proper steps have been taken to completely prohibit the sale of these items or prevent the visitors from carrying these prohibited items to the Falls area while taking bath. As already stated, the polluted water serves as drinking water source for Tenkasi and Tirunelveli area and it is also used for cultivation. Contamination caused by chemicals, soaps, shampoos, sewage etc. would definitely cause health hazards like water borne infections not only to human beings, but would also have an adverse and toxic impact on the vegetation in the area. Rare medicinal plants, shrubs, climbers and grasses grown in that area are bound to be affected and face threat of extinction. The soil is also getting polluted.

14. In M.C. Mehta v. Kamalnath reported in 1997 (1) SCC 388, the Hon'ble Supreme Court enunciated the doctrine of " PUBLIC TRUST ". As per the said doctrine, common properties such as Rivers, Seashores and the air are held by the Government in trusteeship for the free and unimpeded use of the general public and the resources like air, sea, water and forests have such a great importance to the people as a whole and it would be totally unjustified to make them as subject of private ownership. The State as a custodian of the natural resources, has a duty to maintain them not merely for the benefit of the public, but for the best interest of flora and fauna, wild life and so on. Therefore, appropriate steps for preservation of ecology are a must.

15. There may be some justification, if water pollution takes place incidentally when there is development by way of infrastructure building. Whereas without any justification, river water is polluted. When the falls gives pleasure, joy and happiness, what is least expected is not to pollute, contaminate, degrade and meddle with ecosystem whereas mankind is doing disservice to the system by avoidable pollution. After deriving pleasure from the bath in the falls, man reciprocates by polluting the water which is nature's bounty. "Water is praised by Saint Thiruvalluwar about more than 2000 years ago in his classic "THIRUKKURAL"


Without Water, human beings and non-humans like animals, birds and all vegetation on the earth cannot survive in this world. When the rain fall is declining, nowadays due to man-made destruction like deforestation, pollution, it is the duty and obligation cast upon the humans to preserve the purity of water for the well being of all lives and vegetation in the world. The Hon'ble Apex Court in T.N.Godavarman Thirumalpad vs. Union of India reported in 2002 (10) SCC 606 emphasised about the duty of the Government and citizens to protect the environment.

"31. Today, the State and citizens are under a fundamental obligation to protect and improve the environment including forests, lakes, rivers, wild life and to have compassion for living creatures." 15a. A report "Ecomarketing in Courtallam of Tirunelvelli District, Tamilnadu, by St Xavier's College, Palalyamkottai down loaded from Internet, gives the following details:

" Therefore, a study was undertaken in the peak South-west tourist season to assess the eco marketing measures. After carrying out analytical study of various water samples, it was found that although the river was not found highly polluted, biological quality was found significantly poor. Excluding sulphate, all the other physics-chemical parameter analysed were found within the permissible limits. However, the total faecal californium exceeded the permissible limits indicating a poor status of the river .

The report further states that hydro chemical level of Courtallam water is increasing from year to year due to increased pollution load viz. entry of domestic sewage and anthropogenic activities in Courtallam and its adjacent areas. Enormous quantity of oils and detergents used by tourists, causes eutrophication and threatens the life of aquatic species; Bacterial densities and the total faecal californium got increased in all the falls and rivers indicating that water is unsuitable for drinking purposes.

16. The above report only gives the details about the negative consequences of the ecological problem viz. pollution of the river. Therefore, it is time to wake up and rise to the occasion and prevent pollution and take appropriate remedial measures to reverse the ecological damage and conserve the ecology.

17. The report further warns about the use of polythene bags/plastic bags. Plastic bags are made from non renewable natural source, petroleum. Plastic is one of the major reasons for dwindling natural resources and is an agent of air pollution, cancer, skin diseases etc. Plastic use is like a slow poison in daily life. Plastic is not biodegradable and lasts 1000 years on land and 450 years in water. In view of the above negative harmful effects on human beings and environment, use and sale of polythene/plastic items in Courtallam have to be prohibited for the purpose of environmental security and ecological conservation.

18. It is evident from the photographs shown by the petitioner and the Advocate Commissioners' report that there are no proper safety measures provided in the Falls area and there are many cavities and holes found in the bath area; and other essential infrastructure are also lacking. There is no proper mechanism to control and regulate the crowd. Since this is a Public Interest Litigation, instead of finding fault with the authorities, it would be appropriate to direct the authorities to provide appropriate facilities to the visiting public and to improve the infrastructure in Courtallam and to keep hygienic, litter free, plastic and polythene free and eco-friendly Courtallam.

19. That apart, Courtallam Town itself is said to be littered with garbage making it unhygienic. We basically lack civic sense unlike our Keralite brothers and that is the reason why, places in Tamil Nadu are mostly dirty and unhygienic. We should change our attitude and be concious about the hygiene. Then only our State can attract more tourists. Tamil Nadu is an enchanting tourists destination. Temples, historical monuments and natures' beauty are enormous. Wild life, bird sanctuaries, waterfalls, second longest beach, breathtaking valley view, mangrove forests, historical places, heritage and culture, music and dance are enormous and plenty. In the year 2011, 1400.59 lakhs tourists visited Tamil Nadu and in the year 2012, 1876.99 lakhs tourists visited Tamilnadu, standing next to Maharashtra in tourists arrival and standing next to Andrapradesh and Uttrapradesh in domestic tourists arrival and the same has to be increased by maintaining good atmosphere. It is disheartening to note that the tourists, who visit not only Courtallam but anywhere in Tamilnadu, which is known for its hospitality are being fleeced by touts and traders.

20. The report filed by the Assistant Superintendent of Police, Tenkasi giving the details of offences committed in Courtallam for the past 10 years which is as follows:

From the above, it is clear, drunken driving and accidents are more. Deaths due to accidents and fall in the falls are also more. Therefore ,police should be more vigilant. Visible policing would create a moral fear. People coming to enjoy the season should go back safely without any problem.

21. In the above circumstances, this Court gives the following directions to the Respondents:

(I) This Court prohibits the use of oil, shampoos, soaps, detergents, chemicals and shikakai, plastic items and washing of clothes in the bath area of all the falls and sale of the said items are prohibited in Courtallam area except for the personal use of the people who are natives of Town Panchayat. The authorities should over see to it that the prohibited items are not carried to the bathing area and if they are found, they shall be seized and fined.

(II) The safety pillars and railings should be made of materials which do not rust due to water and climatic conditions and they have to be erected, fixed and painted before the season begins well in advance every year. The pits and holes in the bath area have to be closed with good quality concrete, which can withstand the heavy downpour. Everyday, the officials shall have to monitor as to whether the railings and pillars have been damaged or not and if they are found to be damaged, immediately, they shall be either repaired or replaced.

(III) More High Mast Lights shall be erected in the Falls area and they should be maintained properly to prevent any offence being committed under the cover of darkness.

(IV) There is no light in 2 km road from Toll point to old falls and therefore, the authorities are directed to provide road lights within twenty four hours, as there would be movement of people round the clock during season.

(V) The toilets in the Old Falls area as well as in the other Falls area and in the bus stand shall be repaired and more toilets should be constructed, both Indian Style and Western Style with septic tank. The authorities should take into consideration the number of people visiting the place during the season and accordingly, construct toilets, as many heinous crimes are committed like gang rape and murder of sisters in Uttarpradesh recently, when women are constrained to use open space due to lack of toilets.

(VI) Women should be appointed exclusively for maintenance of women toilets and dressing rooms.

(VII) The respondents are directed to stop discharge of sewage into the river forthwith and the toilets should be shifted away from the river area within twenty four hours so that river does not get polluted with sewage. For maintenance of toilets in all the Falls area, Sulabh International or Local Rotary Club or Lion's Club, as suggested by the Advocate Commissioners, can be engaged.

(VIII) More dressing rooms have to be made available as the rooms available at present are totally inadequate; Even the rooms, which are available are said to be not having proper doors and proper lighting and therefore, they should be attended to immediately and periodically. Proper and enough lighting should be done.

(IX) The Drinking Water RO system near the Main Falls is directed to be repaired and more RO systems for drinking water have to be provided at the earliest.

(X) For removing the garbage, it is noted in the Advocate Commissioners' report, that the number of sweepers available is 23 at present, which is inadequate. Therefore, Courtallam Town Panchayat is directed to increase the number of sweepers at least to 50 for clearing the garbage in the area or engage more sweepers during season time, so that collection and removal of garbage can be done easily and effectively.

(XI) The Government Authorities are directed to provide bar facilities to Tasmac Shops as early as possible.

(XII) This Court prohibits drinking in open spaces, public roads and even in cars. The Police is directed to see that people do not drink in open spaces, public roads and even in cars and seize the liquors and fine the violators for causing nuisance to the public. The police can videograph the persons who are found to be drinking so that they do not escape from prosecution.

(XIII) Warning boards informing about prohibition of consuming liquor in the open spaces and road or prohibition of people having bath after consumption of alcohol should be placed immediately; It is to be informed through public address system.

(XIV) If Tasmac Shop is located near the Falls area, it shall be shifted away from the Falls area within fourty eight hours, in the interest of the visiting public, especially, women and children. (XV) This Court prohibits inebriated people going for bath in the falls as there is likelihood of such people losing balance and falling in the falls endangering their lives.

(XVI) To ascertain whether any person has consumed liquor, it is necessary for the Police personnel to have breathe analysers, at least numbering 10, which can detect consumption of alcohol. It is reported that only one such instrument is available with Courtallam Police and even that is not functioning. Hence the said instruments have to be provided by the Government at the earliest.

(XVII) Health inspectors shall visit hotels and eateries to check the quality of food supplied to the people periodically and unhygienic eateries/hotels have to be sealed and closed and appropriate proceedings have to be taken against them. Further concerned authority shall also prohibit exorbitant charging of food items.

(XVIII) It is stated that the total strength of Police Force attached to Courtallam Police Station is 82 whereas the present strength is stated to be 31 only. Of these 31 Policemen, 17 Policemen are stated to be allotted to other duties reducing the strength to 17. Therefore, filling up the vacancies, so as to increase the strength of the Police Force including required Women Police is the need of the hour. The 2nd respondent, Superintendent of Police, is directed to fill up all the vacancies. If more Police personnel are required, the same shall be mustered from other areas during the season to control the crowd and to prevent commission of offences.

(XIX) To prevent drunken driving and commission of offences, as a deterrent, the Joint Director of Health Services Tirunelveli is directed to station a Mobile Medical Lab in Courtallam area so that if anyone indulges in drunken driving, he can be immediately tested in the lab for appropriate legal action.

(XX) A Mobile Court is directed to be stationed so that the offenders get tried immediately and the presence of Mobile Court will deter people from indulging in criminal activities including, drunken driving, eve teasing etc. (XXI) The Joint Director of Health Services, Tirunelveli is directed to keep the Health Centre/Hospital to function 24 hours during the season to take care of medical emergencies. Even during the visit, it is stated that one of the Advocate Commissioners fell on the railings and got hurt on his forehead and there were no medical facilities available in Courtallam and he was taken all the way to Tenkasi.

(XXII) Near the Falls area, mobile medical units, ambulances and rescue teams, are directed to be stationed by the authorities forthwith. (XXIII) The respondents are directed to find out and allot more space according to the parking requirements during the season by taking forest lands as indicated in the Advocate Commissioners' report. Adequate parking area shall be provided for two wheelers as well as four wheelers.

(XXIV) The parking fee should be correctly indicated in the board, correct amount has to be collected and proper receipt should be given by the uniformed staff, who shall wear their identity cards. The details of the staff should be given to the police to prevent collection by unauthorised persons. The authorities shall oversee to prevent any overcharging and complaints should be immediately addressed and action should be taken against violations.

(XXV) The environment in "Courtallam" area needs to be maintained, improved and made eco-friendly. Therefore, selling and use of plastics including carry bags, sachets, cups etc. is hereby prohibited in Courtallam. (XXVI) Entry into forest area should be restricted and the forest area should be kept clean and tidy. If people are allowed to enter the forest area, it will endanger the natural environment and sometimes, there is possibility of anti-national elements entering into the forest area. (XXVII) Police is directed to round up touts who are fleecing the tourists.

(XXVIII) Minibus or buses shall be operated between Old Falls and Main Falls.

(XXIX) The authorities are directed to remove the encroachments made on the roads by shop-keepers/vendors, at the earliest, so that the traffic flow would be free.

(XXX) Since people visiting Courtallam during the season are more than a few lakhs, more offences are likely to be committed and therefore, Closed Circuit Television Cameras should be installed in important locations like Car parking area, Falls area, Temple, Bus-stand and wherever required. Therefore, the respondents especially the Government, the Tourist Development Corporation, local bodies are directed to allocate sufficient funds in this regard. It is brought to the notice of this Court that the Deputy Superintendent of Police, Tenkasi, has already filed a detailed report dated 31.12.2013 suggesting installation of 25 CCTV cameras for Phase-I and 25 CCTV Cameras for Phase II, totalling 50 CCTVs and 10 Wireless installations and the said report is directed to be acted upon at the earliest.

(XXXI) It is stated in the Commissioners' report that Old Falls, which comes under Ayeriperi Village Panchayat, is maintained by P.W.D. Authorities whereas parking collection goes to Ayeriperi Village Panchayat without corresponding obligation. Therefore, the Collector, the first respondent shall consider the suggestion of Advocate Commissioner's to transfer the collection of parking fee and other charges to the P.W.D. (XXXII) As Courtallam has four entry points from 1) Tenkasi 2) Sencottah; 3) Mathalamparai and 4) Ilanji and is stated to be choking due to increase in vehicular traffic, a Scientific study of the inflow and outflow of tourist traffic, as suggested by the Advocate Commissioners' report, shall be done and appropriate remedial measures shall be taken at the earliest. (XXXIII) It is indicated in the Advocate Commissioners' report that as Courtallam Police Station has wide unscientific jurisdiction, the Government shall consider the suggestion of redrawing the boundaries of Tenkasi and Courtallam Police Stations by forming TENKASI TOWN, TENKASI RURAL and COURTALLAM Police Stations for better police administration.

22. Apart from the above directions, the District Collector and the District Superintendent of Police shall make periodical surprise visits to Courtallam and their visits will go a long way to make the officials to work with responsibility. No one should expect that everything would be done and taken care by the authorities and police and it should be the duty of every person to behave properly, keep the town clean without throwing waste, food materials and other litters in the public place. Every one should abide by law and regulation to avoid accidents and deaths. Those who drink should avoid drinking in public place or indulge in drunken driving. It is every one's duty to preserve and protect the falls, a nature's gift. Then only the feel of "Gentle sprinkle of Water" called "SARAL" would last till every visitor returns home safely.

23. This Court appreciates the petitioner who is a practising lawyer to bring to the notice of this Court about the pathetic condition of Courtallam by this Public Interest litigation. This Court records its appreciation for the wonderful work done by the Advocate Commissioners who visited Courtallam and filed report within forty eight hours. They also declined to receive any remuneration, stating that it is their small contribution to the society.

24. For the present, the above directions are given. The writ petition is kept pending for issuing continuous mandamus. The Advocate Commissioners are at liberty to visit whenever they want during season and file reports before this Court regularly. The respondents shall file compliance report before this Court giving the details as to how, the directions given in this order have been complied with.

கந்தன் கருணை பாடல்

கோயில்கள் - ஒரு பார்வை

இமயம் முதல் குமரி வரை பரந்து விரிந்துள்ள இந்த புனிதமான பாரத நாட்டில் உள்ள தமிழ்நாட்டில் எத்தனை எத்தனையோ சிவாலயங்களும், விஷ்ணு ஆலயங்களும் உள்ளன. 108 திருப்பதிகள் அல்லது 108 வைஷ்ணவ திவ்ய தேசங்கள் என்று போற்றப்படும் விஷ்ணு ஆலயங்களில் 84 ஆலயங்கள் தமிழ்நாட்டில் தான் உள்ளது. அதே போன்று இந்தியாவில் பல சிவன் கோயில்கள் இருந்தாலும், குறிப்பாக பாடல் பெற்ற சிவஸ்தலம் என்று போற்றப்படும் 274 ஆலயங்களில் 264 கோயில்கள் தமிழ்நாட்டில் தான் உள்ளன. இந்த கோயில்கள் ஒவ்வொன்றும் தனிச்சிறப்பும், தொன்மையும், பெருமையும் உள்ளவை.

கலியுகத்தில் பிறவி எடுத்தோர் உய்யும் மார்க்கத்தைப் பெறுவதற்குத் துணையாக இருப்பது சிவ மந்திரம், சிவ தரிசனம், சிவ வழிபாடு முதலியனவாகும். இவை மூன்றும் வாழ்வில் இன்றியமையாதவை. சிவமே எல்லா உலகங்களுக்கும், எல்லா உயிர்களுக்கும் முதலானவன். எல்லாம் சிவமயம்! எங்கும் சிவமயம்! எதிலும் சிவமயம்!

ஆம். நமசிவாய என்ற ஐந்தெழுத்து மந்திரத்தை தினமும் ஜபித்து வந்தாலே வாழ்வில் எல்லா கஷ்டங்களும் நீங்கிவிடும். சிவன் கோவிலுக்கு சிறிதளவு பணி செய்தாலும் மகத்தான பலன் கிடைக்கும். சிவலிங்கத்திற்கு வலை கட்டி பாதுகாத்த சிலந்தி மறு பிறவியில் கோட்செங்கட் சோழனாகப் பிறந்து தமிழகத்தில் பல மாடக்கோயில்களைக் கட்டி சிவன் திருப்பணி செய்து புகழ் பெற்றான். சிவன் கோயில் விளக்கு எரிய திரியை தூண்டி விட்ட எலி மறு பிறவியில் சிவன் அருளால் மகாபலி சக்ரவர்த்தியாகப் பிறந்தான். சிவ நாமத்திற்கு அப்படியொரு மகிமை. சிவசிவ என்று தினமும் மனதால் நினைத்து உச்சரித்தாலே போதும். பாவங்கள் நீங்கும். மனம் தூய்மை அடையும்.
